July 17

• Walgreens, 20 W. Market St., Troy — No violations were documented at the time of inspection.

• DJ Pizza Alley, 18 S. Second St., Tipp City — Repeat: Cooking and/or baking equipment not cleaned when required. Observed pizza conveyor oven with a severe build-up of grease deposits and other debris. Discussed ample cleaning frequency with PIC to prevent a build-up and preclude accumluation of cooking equipment.

Repeat: Floor and wall junctures not properly coved or closed and/or floor drains not provided. Observed cove base outside of employee restroom coming loose from the floor/wall juncture. Cove base shall be properly coved to facilitate adequate cleaning and to prevent areas for pest harborage. Please repair of replace.

Repeat: Facility not maintained clean. Observed severe build up on floors and walls behind and underneath equipment in the back kitchen area as well as behind the pizza conveyor oven. Physical facilities shall be cleaned as often as necessary to prevent a build-up and to preclude accumulation.

July 20

• Grandpa Joe’s Candy Shop, 1 E. Main St., Troy — No violations were documented the time of inspection.

• 322 Market Street Enterprises Inc., 322 W. Market St., Troy — Critical; Repeat: Employees are not informed in a verifiable manner of their responsibility to report information about their health. No health policy able to be provided by PIC at the time of inspection. Please print email of health policy sent and keep on file to ensure all employees are informed in a verifiable manner their means of reporting conditions pertaining to their health.

Repeat: No written procedures for responding to vomiting or diarrheal events. Print email sent of bodily fluid clean-up procedures and keep on file for all future inspections.

Presence of dead pests or insects. Observed dead bugs near the corners of the walk-in beer cooler as well as in the back room where the 3-comptment sink is located. Remove presence issues and clean facility more frequently.

Outer opening not protected. Side delivery door observed with an inadequate door sweep allowing sunlight to enter beneath the bottom of the door and door frame. Repair or replace to prevent the entry of pests.

Repeat: No sanitizer test kit available. No test strips for sanitizing solution for the cleaning and sanitizing of food contact surfaces of equipment and utensils able to be provided by PIC at the time of inspection. Obtain test strips for bleach sanitizing solution to properly test the accuracy in parts per million (ppm) the concentration of the EPA-approved sanitizer being used in the RFE.

Warewashing equipment and/or components not cleaned at required frequency. Observed 3-comp sink fixtures needing cleaned and also being used to store unnecessary items. Please remove items and clean 3-comp sink so it maintained clean and accessible for use as required in the RFE.

Non-food contact surface(s) not cleaned at the required frequency. Observed cabinet beneath Cappuchino machine with a build-up of debris. Clean as often as necessary to prevent a build-up on non-food contact surfaces of equipment.

Plumbing system not properly maintained. Observed floor sink to 3-comp sink holding excessive water at the time of inspection. Ensure 3-comp’s floor drain is properly draining. Also, ensure 3-comp floor drain is being cleaned to prevent a harborage conditions for pests.

Water treatment device or backflow preventer not inspected/serviced with documentation as required. Observed building backflow last certified in 2018. Contact plumbing company to have building backflow certified (annually).

Accumulation of refuse, recyclables, or returnables. Observed facility dumpster/refuse area to be at full capacity at the time of inspection. Remove refuse at a frequent enough basis to prevent an overflow and to prevent harborage conditions for pests.

• Speedway, 818 N. Market St., Troy — Repeat: Equipment components are not intact, tight or properly adjusted. Observed upright reach in cooler by the check out counter in disrepair. Observed bottom vent cover falling off unit at time of inspection.

Repeat: Non-food contact surfaces of equipment are unclean. Observed food debris inside of reach in freezer underneath oven and upright reach in freezer by checkout counter. Increase cleaning frequency to prevent build up of food debris.

Repeat: Facility not maintained clean. Observed syrup from bag n box soda storage on the floor in the back room. Observed syrup on the floor, soda lines, and wall. Increase cleaning frequency of soda storage area.

• Pizza Hut, 1480 W. Main St., Troy — Non-food contact surfaces of equipment are unclean. Observed food residue and build up on the outside of the dish machine.

Facility not maintained clean. Observed wire shelving holding clean dishes and utensils has food residue and build up on the top and bottom surfaces.

Facility not maintained clean. Observed food build up and residue behind and underneath fixed equipment. Increase cleaning frequency.

July 21

• The Snow Show, 6190 Detrick Road, Tipp City — No violations were documented at the time of inspection.

• Troy Country Club Snack Bar, 1830 Peters Road, Troy — Repeat: Facility not maintained clean. Observed dead insects built up in the corners of the floors and on window sills. Increase deep cleaning frequency in facility.

• Speedway, 1475 W. Market St., Troy — Outer opening not protected. Observed light coming in between the bottom of the door and the threshold of the side emergency door.

Non-food contact surfaces of equipment are unclean. Observed build up of dust and debris on the back side of the speedy freeze machines and the counter they set on.

Ventilation system not maintained. Observed the hood system vent had an accumulation of dust on the inside of the vent. Upon making the PIC aware, he submitted a work order request to Speedway Headquarters.

• American Legion #43, 622 S. Market St., Troy — Critical: Insufficient air gap between the flood rim and the water supply inlet. Observed drain line to ice machine directly submerged in floor drain without an air-gap. PIC trimmed drain line but will need to secure drain line with bracket to ensure adequate air-gap is present (2-4”).

July 22

• S&G, 801 W. Main St., Troy — No violations were documented at the time of inspection.

• 2 Lunas LLC, 12 S. Tippecanoe Drive, Tipp City — Repeat: Facility does not have an employee with manager certification in food protection. No certified individual with Manager’s certification in Food Protection. Manager stated he is working to schedule and take test being offered in Spanish.

Critical; Repeat: Quaternary ammonium sanitizing solution at incorrect temperature, concentration, and/or water hardness. Observed Eco-lab sanitize dispensing unit testing at 10 ppm at the time of inspection. PIC contacted Eco-lab to service. For the time being, facility will have to manually make sanitizing solution and use QUAT test strips to test before use.

Corrected During Inspection; Critical: Improper cooling of TCS food. Observed refried beans dated 7/21/2020 in walk-in cooler tempted to be 50 degrees F. Also observed 3 large, deep containers of enchilada salsa cooling on a stainless steel prep table. According to the manager, items had been cooling for 1 hour and 30 minutes and were tempted to be 140 degrees F. Discussed cooling from 135 to 70 F in 2 hours and from 70 to 41 or below within an additional 4 hours, not to exceed 6 hours. Beans discarded voluntarily and enchilada salsa was moved to grill line to be reheated and cooling process restarted to ensure proper cooling.

Corrected During Inspection; Critical: Ready-to-eat, TCS food not properly discarded when required. Observed verde salsa dated 7/15/2020 in the walk-in cooler. Discussed TCS foods shall be either sold, discarded or consumed by the seventh day to prevent growth. PIC voluntarily pulled verde salsa and discarded at the time of inspection.

Repeat: No sanitizer test kit available. No bleach test strips available for low temp dish machine. Obtain bleach test strips to adequately test concentration of sanitizing solution.

• Meijer Gas Station, 1990 W. Main St., Troy — No violations were documented at the time of inspection.

• Subway Walmart, 1801 W. Main St., Troy — Non-food contact surface(s) not cleaned at the required frequency. Observed build up of soda residue on the soda machine where the nozzles are inserted. Increase cleaning frequency.

Facility not maintained clean. Observed food splatter and residue on the wall behind the prep table.

Facility not maintained clean. Observed water/soda syrup puddled in the cabinet under the fountain machine.

• Jimmy John’s, 1888 W. Main St., Troy — Equipment components are not intact, tight or properly adjusted. Observed ice build up in walk in freezer. Observed ice hanging from the condensing unit as well as on the floor.

Plumbing system not properly maintained or repaired. Observed hand sink along the prep line to be leaking. PIC stated that a work order for the leaking sink has already been put in, they are waiting for a repair person to come out.

July 23

• La Fiesta Mexican Restaurant, 836 W. Main St., Troy — Follow-up inspection: Critical; Repeat: PIC unable to demonstrate knowledge of temperatures and times for safe refrigerated food storage, hot holding, cooling and reheating. At the time of inspection the PIC was unable to properly answer food safety questions.

Critical; Repeat: Person in charge not ensuring proper cooling. At the time of inspection, the PIC was not ensuring that employees were cooling foods properly.

Corrected During Inspection; Repeat: At the time of inspection, a beverage was observed being stored on the prep table adjacent to prepared vegetables. Upon making the PIC aware of this, the beverage was removed from the table.

Critical; Repeat: Food employee(s) did not wash hands when required. On multiple occasions observed employees not washing hands when required (before donning gloves, after engaging in other activities, etc.)

Corrected During Inspection; Critical; Repeat: The back handwashing sink was observed being blocked by the garbage can along with the dry bean white storage container. Upon making the PIC aware of this, the PIC moved both containers.

Corrected During Inspection; Critical; Repeat: Handwashing sink is being used for purposes other than Handwashing. The hand sink between the cook line and dirty dish area was observed being used to rinse cilantro. Upon making the PIC aware of this, the cilantro was discarded.

Critical; Repeat: At the time of inspection, employees were observed leaving the prep area with gloves on and returning without changing gloves or washing hands.

Critical; Repeat: Equipment food-contact surfaces or utensils are unclean. The vegetable slicer was observed with food debris build up.

Corrected During Inspection; Critical; Repeat: Improper use of a poisonous or toxic substance. On the surfaces underneath holding area of the freshly made plates of food, cockroach bait was observed above clean plates, bowls and other food contact surfaces. Upon making the PIC aware of this, the clean food contact surfaces were removed and the cockroach bait was removed. Cease the placing of bait above any food contact surfaces or food items.

Corrected During Inspection; Critical: In the back prep area, a working container of bleach was observed being stored adjacent to the prepared vegetables. Upon making the PIC aware of this, the working container of bleach was removed.

Corrected During Inspection; Repeat: In the walk-in cooler, large containers of salsas and pans of chicken and other food items were observed holding between 46 F and 54 F. The dates on the containers of food and different types of salsas were observed reading 7/22 and the PIC indicated the food was prepared on 7/22. Upon making the PIC aware of this, all the food items improperly cooled were discarded.

Repeat: In the dry stock area, dead cockroaches were observed in the light shields.

Critical; Repeat: At time of inspection, an odor was being emitted from the dirt dish area and standing water was observed.

Repeat: Food not protected from environmental sources of contamination during preparation. In the walk-in cooler, multiple containers of queso dip were observed uncovered.

Repeat: Raw fruit and/or vegetables not washed or washed improperly. During prep and after rinsing, observed a bunch cilantro with a rubber band around it. Upon making the PIC aware of this, the PIC discarded the cilantro.

In multiple locations, clean bowls, utensils and other food contact surfaces were observed being stored below HVAC vents with dripping water. Upon making the PIC aware of this, the PIC began the process of relocating bowls, utensils, etc.

Previous inspection on July 16:

Critical: Person in charge not ensuring proper cooling. At the time of inspection, the PIC was not ensuring that employees were cooling foods properly.

Critical: PIC unable to demonstrate knowledge of temperatures and times for safe refrigerated food storage, hot holding, cooling and reheating. At the time of inspection the PIC was unable to properly answer food safety questions.

Employee eating, drinking, or using tobacco in non-designated area. Observed a food employee drinking from an open container while prepping food. Observed drink stored on prep table.

Critical: Improper washing of hands and arms. Observed food employees washing hands for less than 20 seconds.

Critical: Food employee(s) did not wash hands when required. On multiple occasions observed employees not washing hands when required (before donning gloves, after engaging in other activities, etc.)

Corrected During Inspection; Critical: Improper bare-hand contact with RTE foods. When prepping, observed bare hand contact while cutting tomatoes and cilantro. Upon making PIC aware, the sliced tomatoes and cilantro were discarded.

Critical: Handwashing sink is being used for purposes other than handwashing. Observed hand sink being used to fill stock pots with water.

Critical: Handwashing sink not accessible. Observed a trash can and mop bucket being stored in front of hand sink adjacent to the prep sink.

Corrected During Inspection: No towels or drying device at the handwashing sink(s). At time of inspection hand sink in the back prep area by the walk-on cooler did not have disposable hand towels.

Corrected During Inspection; Critical: Handwashing sink is being used for purposes other than handwashing. Observed hand sink being used as a dump sink in the back kitchen area along the cookline.

Critical: Single-use gloves used improperly. Observed gloves being used for multiple tasks.

Critical: Utensils and food-contact surfaces of equipment not sanitized at the required frequency. Observed ice machine to have a black mold like substance inside on the roof top bar.

Corrected During Inspection; Critical: Equipment food-contact surfaces or utensils are unclean. Observed two knives in hanging storage container unclean with food debris build up.

Critical: Equipment food-contact surfaces or utensils are unclean. Observed vegetable slicer to be unclean with food debris build up.

Critical: Utensils and food-contact surfaces of equipment not sanitized at the required frequency. Observed chip baskets not being wash, rinsed, and sanitized between uses.

Corrected During Inspection; Critical: Improper cooling of TCS food. In the walk in cooler, observed 4 large containers of sauces prepared on 7/15 with temperatures between 47-64 degrees.Upon making the PIC aware of this, all the sauces were discarded at time of inspection.

Corrected During Inspection; Critical: TCS foods not being cold held at the proper temperature. Observed two open bottles of ranch dressing at room temperature. PIC discarded.

Corrected During Inspection; Critical: Ready-to-eat, TCS food not properly discarded when required. Observed burrito sauce date marked for 7/8 in the walk in cooler. Upon making PIC aware of this the burrito sauce was discarded.

Corrected During Inspection; Critical: Refrigerated, ready-to-eat, TCS foods not properly date marked. Observed enchilada sauce in the walk in cooler without a date marking. Upon making PIC aware, the enchilada sauce was date marked.

Critical: Improper use of time as a public health control (4 hours). At time of inspection, the salsa was not time stamped.

Corrected During Inspection; Critical: Working containers of poisonous or toxic materials not properly labeled. Observed working container without common name. Upon making PIC aware, the working container was properly labeled.

Critical: Improper use of a poisonous or toxic substance. Observed dried cockroach bait above clean utensils, and on walls in multiple locations throughout the kitchen.

Corrected During Inspection; Critical: Improper storage of poisonous or toxic materials. In the roof top bar observed hazardous chemical spray can stored with utensils in a cabinet.

Improper method for cooling TCS foods. Observed large amounts of sauces being cooled together.

Ambient air and water thermometers are not accurate. At time of inspection, observed hot water sanitizing dish machine temperature measuring device reaching 170 during the final rinse cycle.

Repeat: Outer opening not protected. Observed a gap between the exterior door and the threshold of the back kitchen door.

Critical: At time of inspection, an odor and standing water was present in the dish area.

Critical: Presence of live insects, rodents, and other pests. Observed live cockroaches behind the dishwashing machine.

Presence of dead pests or insects. Observed dead cockroaches in light shields.

Critical: Observed rodent droppings inside cabinets in roof top bar.

Food not protected from environmental sources of contamination during preparation. Observed containers of cooked food in the walk-in cooler not covered.

Corrected During Inspection: Improper storage of food items. Observed food being stored on the floor in the walk-in cooler and freezer. Observed tubs of raw chicken being stored on the floor of the walk-in cooler. Observed boxes of raw chicken stored on the floor of the walk-in freezer. Upon making the PIC aware of this at time of inspection, both the tubs and boxes were relocated to be six inches off the ground. Observed two stock pots, one filled with salsa and one filled with cheese, both sitting on the floor of the kitchen.

Improper storage of food items. Observed sugar packets being stored under the sink drain for the downstairs bar hand sink.

Food not protected from contamination. Food debris build up was observed on trays stored above salsa.

Food employee(s) not wearing a hair restraint.

Improper use and/or maintenance of wiping cloths. Observed wet cloth out on the table, not stored in the sanitizer.

Raw fruit and/or vegetables not washed or washed improperly. During prepping, observed onions and cilantro being cut without being rinsed prior.

In-use utensils improperly stored. Observed a bowl being used to scoop nacho chips and observed a food employee using a cup to scoop ice.

Observed clean bar glasses stored next to hand sink and not protected from splashing.

Clean equipment and utensils not stored in a self-draining position and covered or inverted. Observed clean utensils not inverted while stored in kitchen.

Observed clean bowls and plates not turned over while stored.

Corrected During Inspection: Improper use of food contact surfaces containing wood and/or wicker. Observed unapproved wood material being used as cutting board. PIC discarded at time of inspection.

Equipment not approved by a recognized testing agency. Observed non-commercial utensil being used for food contact. Observed wooden handled strainer in dirty dish area.

Equipment components are not intact, tight or properly adjusted. Observed the lid of the chest freezer in disrepair.

Equipment components are not intact, tight or properly adjusted. Observed water leaking from the beer cooler drain line.

Irreversible registering temperature indicator not readily accessible for hot water mechanical warewashing operations.

Non-food contact surface(s) not cleaned at the required frequency. Observed a black mold like substance on the cabinets in the roof top bar and in the 3 compartment bar sink.

Non-food contact surface(s) not cleaned at the required frequency. Observed external surfaces throughout the kitchen (dishwasher, fryers, etc.) along with shelving units in walk-ins, dry stock areas, and dirty dish area with food, dirt and dust debris build up along with a black mold-like substance build up.

Critical: Insufficient air gap between the flood rim and the water supply inlet. Observed ice bin at the downstairs bar to be without an air gap.

Improper disposal of condensation and other nonsewage liquids. Observed condensate from air conditioning unit pooling on the roof.

Physical facilities not maintained in good repair. Observed water damaged ceiling tiles in the hallway leading to the bar. Find source of water damage and repair.

Observed employee clothing and cell phones being stored throughout the food facility, not in a designated area.

No protective shielding on lights. Observed non shatterproof light bulbs in roof top bar.

Ventilation system not maintained. Observed oil and grease build up on ventilation hood. Facility to provide documentation that hood ventilation system has been cleaned on the inside and out.

FSO did not submit facility layout and equipment specifications. Observed unapproved storage trailers behind the kitchen in the parking lot.
